Terms of Service

1. Acceptance of Terms

By creating an account or using Hootbrook Learning (“the Service”), you agree to these Terms of Service. If you are registering on behalf of a child, you confirm that you are the child's parent or legal guardian.

2. The Service

Hootbrook Learning provides an adaptive online learning platform designed to help primary-school children (ages 5–12) prepare for Australian selective school entrance tests including NSW OC, NSW Selective, ICAS, and related exams.

The Service includes personalised practice questions, progress tracking, readiness scoring, and AI-powered feedback. Questions are mapped to Australian Curriculum v9.0 content descriptors across Mathematics, English, Science and Digital Technologies, and to the England National Curriculum KS2 programmes of study for maths and English.

3. Accounts

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • Parent accounts may create and manage child accounts
  • You must be at least 18 years old to create a parent account
  • One subscription covers all child accounts linked to a parent account

4. Subscriptions & Payments

  • Hootbrook offers a single yearly subscription plan that includes all content and covers up to 4 children; the current price is shown at checkout
  • The plan includes a 7-day free trial
  • Payments are processed securely by Stripe
  • Subscriptions renew automatically unless cancelled before the renewal date
  • You can cancel at any time from your account settings (Account → Subscription) — access continues until the end of the current billing period
  • Prices may change with 30 days' notice to existing subscribers

5. Free Trial

New users receive a 7-day free trial with full access to all features. Your card is not charged during it. If you cancel before the trial ends, you won't be charged. Access to premium features stops when the trial ends. If you do not cancel, your subscription begins automatically when the trial ends.

6. Refunds & Cancellation

You can cancel at any time from your account settings (Account → Subscription). When you cancel, access continues until the end of the current billing period. In short:

  • A 30-day money-back guarantee on your first payment
  • A full refund of any annual renewal charge if you ask within 14 days of that charge
  • After that, cancel any time for a pro-rata refund of the unused whole months of the current year

Your statutory rights

Nothing in these Terms excludes rights that cannot lawfully be excluded. In Australia, our services come with consumer guarantees under the Australian Consumer Law that cannot be excluded — including, for a major failure, a refund of the unused portion or compensation for its reduced value. In the United Kingdom, your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 prevail over anything in these Terms to the contrary.

Where you subscribe through the Apple App Store, Apple is the seller and refunds are handled under Apple's terms. Your statutory rights are unaffected.

7. Acceptable Use

You agree not to:

  • Share account credentials with others outside your household
  • Attempt to extract, scrape, or bulk-download question content
  • Reverse-engineer the adaptive learning algorithm
  • Use the Service for any purpose other than educational learning
  • Interfere with or disrupt the Service's operation
  • Impersonate another user or provide false information

8. Intellectual Property

All content on Hootbrook — including questions, explanations, illustrations, curriculum mappings, and the adaptive engine — is the intellectual property of Hootbrook Learning. You may not reproduce, distribute, or create derivative works from our content without written permission.

Your child's learning data (responses, scores, progress) belongs to you and can be exported or deleted upon request.

9. AI-Generated Content

Hootbrook uses AI technology (powered by Anthropic's Claude) to provide personalised feedback, hints, and writing assessments. While we strive for accuracy, AI-generated responses may occasionally contain errors. AI feedback should be used as a learning tool alongside, not as a replacement for, professional educational guidance.

10. No Guarantee of Outcomes

Hootbrook provides tools and practice to support test preparation. We do not guarantee any specific test score, school placement, or educational outcome. Results depend on many factors including the student's effort, consistency of practice, and individual ability.

11. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Hootbrook Learning's liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Nothing in these terms excludes your rights under the Australian Consumer Law that cannot be excluded by contract.

12. Termination

You may close your account at any time by contacting us. We may suspend or terminate accounts that violate these terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

13. Changes to These Terms

We may update these terms from time to time. We will notify registered users of material changes via email at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
